Does the CSB Have the Authority to Investigate the Deepwater Horizon Accident?

What happens when a federal agency claims the right to investigate an accident and the company contests their authority? We’re about to find out.

Yesterday, the Justice Department filed a civil action against Transocean to compel them to respond to subpoenas from the Chemical Safety Board. Here’s a story about it in the Houston Chronicle:

Does the Chemical Safety Board (created to investigate chemical accidents) have it within their charter to investigate offshore oil spills? Eventually, we’ll see what a federal judge has to say.
